Penalties for Non-Compliant Electronic Invoices in Morocco 2026

Fines, penalties, reassessments: what are the penalties for a non-compliant electronic invoice in Morocco in 2026? Avoid them with Inyad.

What Penalties Apply to Non-Compliant Electronic Invoices in Morocco in 2026?

Penalties for non-compliant electronic invoices in Morocco announced by the DGI for 2026 range from administrative fines to flat tax penalties, plus VAT reassessment. A negligent SME could see its total bill exceed 100,000 DH in a single fiscal year, not counting late interest.

Three main categories of violations are penalized: not issuing in the compliant format, failing to transmit to the DGI platform, and failing to legally archive. Each category has its own fine schedule detailed in DGI circular 2025-XX.

What Fines Apply for Not Having a Compliant Invoice?

The DGI fine for missing invoices is set at 50% of the amount of the transaction concerned, with a floor of 1,000 DH per missing invoice. For a 5,000 DH sale not properly invoiced, the penalty is therefore 2,500 DH. Across 20 non-compliant invoices in a year, the total adds up quickly.

Recurring violations make the penalty worse: a 100% surcharge applies past the third violation in the same fiscal year. Automated DGI checks detect these repeat offenses instantly.

How Are Late Penalties Calculated?

An invoice not transmitted to the DGI on time triggers a late penalty of 0.5% per month of delay, capped at 25% of the amount including tax. For a 100,000 DH invoice transmitted 6 months late, the penalty reaches 3,000 DH. This penalty is added to any other applicable sanctions.

  • 0.5%/month: late interest on an untransmitted invoice.

  • 15% minimum: surcharge for a first offense.

  • 100%: aggravated repeat offense.

What Criminal Risks Exist for Serious Fraud?

Beyond financial penalties, serious tax fraud (fictitious invoices, organized concealment) exposes you to criminal prosecution: a fine of 5,000 to 100,000 DH and imprisonment from 1 month to 3 years under the Moroccan General Tax Code. The business owner is held personally liable, even within a company.

Fake invoices issued to inflate deductible expenses are the leading cause of criminal tax prosecutions in Morocco. Certified software makes these practices impossible: every invoice is signed, timestamped, and traceable.
