E-Invoicing: What Are the Risks of Non-Compliance?
Fines per invoice, loss of the right to deduct VAT: non-compliance with e-invoicing can be costly. A look at the known risks and how to protect yourself.

What Does the Regulation Say Today?
Let’s be precise: to date, no specific penalty scale for e-invoicing has been officially published. Article 145-IX of the General Tax Code refers implementation details to regulatory measures. It is the implementing decree, still pending, that will specify the penalties for the system.
This does not mean you should wait: the consequences of non-compliance, once the reform is fully in effect, can be severe.
Risks Mentioned So Far
Fine per non-compliant invoice: several sources mention a fine of around 500 dirhams per non-compliant invoice, up to an annual cap of around 50,000 dirhams.
Loss of the right to deduct VAT: this is the most serious consequence. A non-compliant invoice could no longer give the buyer the right to deduct VAT.
Why the Loss of VAT Deduction Makes the Difference
The real financial stake isn’t the fine, but VAT. Take an example: for a company with 10 million dirhams in annual purchases including tax, the non-deductibility of VAT would represent a loss of around 2 million dirhams. That’s an impact far beyond the fine cap.
Beyond the numbers, an invoice rejected by your suppliers or customers also means delayed payment and a weakened business relationship.
How to Protect Yourself?
Plan ahead for your deadline: don’t wait until the last minute to get equipped.
Use compliant software: good software prevents issuing an incomplete or badly formatted invoice.
Check the invoices you receive: make sure your suppliers also issue compliant invoices, since your right to deduct depends on it.
Follow DGI communications: the regulation is becoming clearer over time.
The best protection remains anticipation. Getting equipped early with a compliant solution neutralizes the risk before it even materializes.
